Privacy Consent Form
By accepting this document, you consent to us, Fundo Loans Pty Ltd ACN 604 639 143, Australian Credit Licence 491418, and Wagego Pty Ltd (ACN 687 117 273) and our related bodies corporate, affiliates and agents ('we', 'our', 'us') collecting, using, holding and disclosing personal and credit-related information about you as stated in this document.
Obtaining and using your bank statements
We may obtain your past bank statements and periodically obtain updated bank statements in relation to accounts you give us information about on an ongoing basis for this purpose. We may use this information to assess whether certain products we offer are suitable for you and to tell you about products you may be interested in that we offer. We may also share this information with our related bodies corporate, service providers and other third parties as described in our Privacy Policy for this purpose, including third-party service providers who process your bank statement information on our behalf. You may withdraw this consent at any time by contacting us, in which case we will cease obtaining updated bank statements but may continue to use the bank statement information we already hold in accordance with this document. If you withdraw your consent, we may be unable to continue providing some or all of our products or services to you.
Credit reporting information
You consent to us obtaining credit reporting information about you from credit reporting bodies ('CRBs') for the purpose of assessing your application for credit, assessing your creditworthiness, and managing credit that we provide to you. You acknowledge that the CRBs may record the fact that we have made such an enquiry and that this may be included in credit reporting information provided to other credit providers. We will only use and disclose your credit eligibility information for the purposes permitted under Part IIIA of the Privacy Act 1988 (Cth) and the Privacy (Credit Reporting) Code. Your credit eligibility information will not be used or disclosed for the purposes of direct marketing, cross-selling, or any targeting or invitation in relation to credit. If you do not consent to us obtaining credit reporting information about you, we may be unable to assess your application for credit.
Direct marketing consent
We may use and disclose your information (excluding your credit eligibility information) to send direct marketing material to you, including via email, SMS, telephone, physical mail or digital advertising (including targeted advertising on social media and other online platforms), to tell you about alternative or new products and services that we offer. We may also share your information (excluding your credit eligibility information) with our related bodies corporate to enable them to tell you about products or services they offer that may be of interest to you, and for analytics purposes (including product development and risk modelling). Your credit eligibility information will not be used or disclosed for the purposes of direct marketing, cross-selling, or any targeting or invitation in relation to credit. You can withdraw this consent at any time by contacting us.
Overseas disclosure
We may disclose your information to businesses located overseas, such as in India, Nepal, Pakistan, People's Republic of China and The Philippines. Overseas entities may be required to disclose this information to relevant foreign authorities under a foreign law. While we attempt to select and secure reputable offshore service providers, we are not liable for any breach or misuse of information sent offshore.
An overseas entity may not be subject to privacy laws or principles similar to those that apply in Australia. Any information disclosed to an overseas entity may not have the same protection as under the Australian privacy law. If you provide us with this consent to make overseas disclosure, you may not be able to seek redress for any breach of your privacy which occurs outside of Australia.
If we disclose your credit-related information to entities that are located overseas, we will take reasonable steps to ensure that the overseas entity does not breach the Australian Privacy Principles in relation to your credit-related information.
Customer identification
We may disclose your name, residential address and date of birth to a CRB or other organisation (including the document issuer or official records holder) to verify your identity. That organisation will use this information to give us an assessment/report of whether or not the information we have matches information held by the organisation, and that may involve use of third party systems and services. If we use these methods and are unable to verify your identity in this way, we will let you know.
We may also use information about your Australian Passport, state or territory driver licence, Medicare card, citizenship certificate, birth certificate and any other identification documents to match those details with the relevant registries using third party systems and to record the results of that matching. This information may be transmitted to New Zealand.
If you do not consent to us disclosing your information in this way, we will verify your identity in another way, which may involve requiring you to provide various supporting identification documents (either original or certified copies).
Definition of key terms
Personal information
Personal information means information or an opinion about an identified individual, or an individual who is reasonably identifiable. Personal information includes, for example, your name, date of birth, address, the number and ages of your dependants, and employment information. If you use our website or mobile applications, we may collect information that relates to your location or activity, including IP address, use of third-party sites, and other user information.
Credit-related information
Credit-related information means both:
- Credit information, which is information which includes your identity; the type, terms and maximum amount of credit provided to you, including when that credit was provided and when it was repaid; repayment history information, financial hardship information (including information that any repayments are affected by a financial hardship arrangement) and default information (including overdue payments); payment information; new arrangement information; details of any serious credit infringements; court proceedings information; personal insolvency information; and publicly available information; and
- Credit eligibility information, which is credit reporting information disclosed to us by a credit reporting body, and any information that we derive from that information that has any bearing on your creditworthiness and that is used, has been used or could be used in establishing your eligibility for consumer credit.
We refer to personal information and credit-related information collectively as 'information' in this document.
